How soon do I have to make a claim?

If you wish to start a clinical negligence case, you must start proceedings within three years from the time when the negligence occurred, or three years from the date that you realised that the treatment had caused significant injury. Different time limits apply to children, people with learning difficulties and sometimes people with mental health problems and. In certain circumstances, a claim may be allowed to go ahead even if time has run out.
